Terms of Service

1. Account responsibility

You're responsible for what happens under your account. Keep your password private. One human, one account. Pen names are first-come, first-served and non-transferable. We may reclaim handles that are squatting on trademarks or impersonating real people.

2. Content ownership

You own everything you write. By saving an entry, you grant Diarly a limited, non-exclusive, royalty-free license to store and display it according to the privacy level you choose. Private entries are never displayed to other users. Anonymous Public, Public, and Subscribers Only entries are displayed only as you intend.

We will never train external AI models on your entries. If we use entries internally for product quality (e.g., evaluating Privacy Helper accuracy on your own writing), it is opt-in and reversible.

3. Prohibited content

Even on a private journal, the following will get you removed and may be reported to authorities:

  • Child sexual abuse material (CSAM) — reported to NCMEC.
  • Explicit sexual content involving real identifiable people without consent.
  • Detailed methods of self-harm or suicide. We support honest writing about mental health; we don't host how-to.
  • Copyrighted material you don't have rights to publish.
  • Coordination of illegal activity, doxxing, stalking, or targeted harassment.
  • Spam, deceptive content, or large-scale automated posting.

4. Enforcement

For minor first-time violations, we issue a warning. Repeated or severe violations escalate to temporary suspension, and finally to a permanent ban. CSAM, doxxing, and credible threats of violence skip straight to permanent ban and law enforcement referral.

5. Payment terms

Diarly is free during pre-launch. Paid creator subscriptions launch in Q3 2026. When they do, we'll publish the exact revenue split, payment processor terms (Stripe Connect), and tax handling here. You will be notified 30 days before any paid feature affects you.

6. Termination

You can delete your account at any time from Settings → Data. We may terminate or suspend your account for violations of these terms. If we terminate non-emergency, we will give you 14 days to export your entries.

7. Liability disclaimer

Diarly is provided “as is.” We are pre-launch software — bugs happen, downtime happens, edges are still being smoothed. To the maximum extent permitted by law, Diarly and its operators are not liable for indirect, incidental, or consequential damages.

We take data integrity seriously: backups, RLS, redundancy. If your data is lost due to our fault, we will work to restore it from backup.

8. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state and federal courts located in Delaware. (Placeholder — finalized before paid launch.)

9. Changes to these terms

Material changes are emailed to you 14 days before they take effect. Continued use after the effective date is acceptance.
